Terms of Service

1. Agreement to Terms

By accessing or using our website, mathsstudyhub.nz (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site.

2. Accounts and Subscriptions

  • Account Creation: To access premium content, you must register for an account. Accounts are managed through our authentication provider, Supabase. You are responsible for maintaining the security of your account and password.
  • Subscriptions: Subscriptions are billed on a recurring basis (e.g., monthly or yearly) in advance. Payments are processed by Stripe.
  • Cancellations: You may cancel your subscription at any time through your "My Account" dashboard. Your access to premium content will continue until the end of your current billing period. Payments are non-refundable.

3. Acceptable Use

You agree not to misuse the Site or its content. The following activities are strictly prohibited without our prior express written permission:

  • Sharing your account credentials with others, or allowing more people to use an account than your licence permits.
  • Reproducing, duplicating, copying, republishing, redistributing, reselling, sub-licensing, framing, mirroring, or creating derivative works from any part of our content — in whole or in part, in any format, whether for commercial or non-commercial purposes.
  • Bulk downloading, harvesting, scraping, crawling, spidering, or any form of automated or systematic extraction of content, questions, model answers, images, audio, lesson transcripts, or any other data from the Site.
  • Circumventing, disabling, or interfering with any access control, rate limit, authentication, licensing check, watermark, or other protective mechanism used by the Site.
  • Reverse engineering, decompiling, or disassembling any part of the Site, its backend APIs, or its client-side code except to the limited extent expressly permitted by applicable law.
  • Using the Site for any illegal or unauthorized purpose.

4. Automated Access, Scraping and AI / Machine Learning

Access to the Site is licensed to human learners and their teachers for personal educational use. Automated access is not permitted. In particular, you, your agents, and any software you operate or direct may not:

  • Use any robot, spider, scraper, crawler, headless browser, or other automated means to access, index, cache, copy, or monitor any portion of the Site or its content, except for search and answer engines operating in compliance with our robots.txt (see the permission below).
  • Use the content — in whole or in part — as input to, or training data for, any artificial intelligence, machine learning, large language model, generative model, embeddings model, recommendation system, or similar automated system, whether for research, commercial, or internal use.
  • Perform text and data mining (TDM) on the Site or its content. Maths Study Hub expressly reserves all rights under Article 4(3) of EU Directive 2019/790, section 29A of the UK Copyright, Designs and Patents Act 1988, and any equivalent or successor provisions in any jurisdiction, and does not grant permission for text or data mining of any content on this Site for any purpose, including the training of AI or machine learning models.
  • Ignore, bypass, or remove any machine-readable opt-out signal we publish (including robots.txt, its Content-Signal directives, noimageai, X-Robots-Tag, or TDM-Reservation metadata).

Permitted retrieval. We permit search engines and AI assistants to retrieve and index this Site in order to return results, summaries, or answers to a person's query, provided they (a) comply with our robots.txt, (b) attribute Maths Study Hub as the source, and (c) include a working link to the page the content came from. This permission covers retrieval and citation only. It does not permit use of any content as training or fine-tuning data, nor text and data mining, both of which remain prohibited and expressly reserved above.

Violating this section constitutes unauthorized access to a computer system and a material breach of these Terms.

5. Intellectual Property

All content on this Site — including but not limited to the questions, model answers, worked solutions, text, graphics, illustrations, audio, video, lesson scripts, interactive activities, source code, and the underlying selection, sequencing, and arrangement of that content — is the exclusive property of Maths Study Hub. It is protected by copyright, database rights, trade-mark rights, and other applicable intellectual property laws in New Zealand and internationally.

Maths Study Hub asserts and reserves all rights in the database(s) underlying the Site, including any sui generis database right where applicable. No substantial part (evaluated qualitatively or quantitatively) of any database may be extracted or re-utilised without our prior written consent. Repeated and systematic extraction of insubstantial parts, where that extraction conflicts with normal exploitation of the database or unreasonably prejudices our legitimate interests, is also prohibited.

You may not use any of our content, data, branding, or derived materials to build, train, evaluate, benchmark, or market any product or service that competes with Maths Study Hub, including but not limited to competing tutoring platforms, question banks, flashcard apps, or AI-driven learning tools.

6. Enforcement and Remedies

We actively monitor the Site for unauthorized access and content reuse. If you breach these Terms, we may, without notice and in addition to any other remedy available to us at law or in equity:

  • Suspend or terminate your account and block your access to the Site;
  • Block IP addresses, networks, or automated clients associated with the breach;
  • Issue takedown notices under the New Zealand Copyright Act 1994, the US Digital Millennium Copyright Act (DMCA), or equivalent legislation in other jurisdictions;
  • Seek injunctive relief, statutory damages, actual damages, disgorgement of profits, legal costs, and any other remedies available to us.

You agree that unauthorized scraping, copying, or use of our content as AI training data would cause us irreparable harm for which monetary damages alone would be inadequate, and that we are entitled to seek injunctive relief in addition to any other remedy.

7. Limitation of Liability

The content on our Site is provided for educational purposes. While we strive for accuracy, we do not guarantee that the content will be error-free. We are not liable for any academic outcomes resulting from the use of our Site.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of New Zealand. You agree that any dispute arising out of or in connection with these Terms, your use of the Site, or any unauthorized access to or use of our content, shall be subject to the exclusive jurisdiction of the courts of New Zealand. Where you access the Site from outside New Zealand and commit a breach of these Terms, you consent to being sued in New Zealand and waive any objection based on forum non conveniens.
